Terms and Conditions for Karrot AI

1. Acceptance of Terms

Welcome to Karrot AI! These Terms and Conditions ("Terms") govern your use of the Karrot AI mobile application (the "App") and any related services provided by us.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

By creating an account, logging in via Google or Apple, or using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

2. Description of Service

Karrot AI is a mobile application designed to scan product barcodes, analyze food ingredients, and provide nutritional information, additive alerts, and health recommendations. The App may also offer premium features through a subscription model ("Karrot Pro").

3. Medical Disclaimer

The information provided by Karrot AI is for informational and educational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment.

• Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, diet, or allergies.
• Never disregard professional medical advice or delay in seeking it because of something you have read on the App.
• Karrot AI does not guarantee the accuracy, completeness, or usefulness of any nutritional information, ingredient lists, or allergen warnings provided. Product formulations change, and manufacturers may not always disclose all ingredients. Always check the physical product label before consumption, especially if you have severe allergies.

4. User Accounts

• Registration: You may need to register for an account to access certain features. You agree to provide accurate, current, and complete information during the registration process.
• Security: You are responsible for safeguarding your password and account credentials. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
• Termination: We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.

5. Subscriptions and In-App Purchases (Karrot Pro)

• Karrot Pro: The App offers premium features through a subscription model called "Karrot Pro."
• Billing: Subscriptions are billed through your Apple ID account. By confirming your purchase, you authorize Apple to charge your account.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. Canceling a subscription will stop future charges, but no refunds will be provided for the current billing period.
• Third-Party Provider: We use Superwall to manage our paywalls and subscriptions. By subscribing, you agree to their terms of service as well.

6. User Content and Conduct

• Camera and Photos: The App requires access to your camera and photo library to scan barcodes and analyze products. You retain ownership of any images you upload, but you grant us a license to use them to provide the Service.
• Prohibited Conduct: You agree not to:
  • Use the App for any illegal or unauthorized purpose.
  • Interfere with or disrupt the App or servers or networks connected to the App.
  • Attempt to reverse engineer, decompile, or disassemble any part of the App.
  • Use the App to transmit any viruses, worms, or malicious code.

7. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Karrot AI and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Karrot AI, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the App.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, or materials included on the App. You expressly agree that your use of the App is at your sole risk.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law provisions.

12. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• Acknowledgment: You acknowledge that these Terms are concluded between you and Karrot AI only, and not with Apple. Karrot AI, not Apple, is solely responsible for the App and its content.
• Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Product Claims: Karrot AI, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including, but not limited to: product liability claims, failure to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Karrot AI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
